Course Title: Wills, Trusts and Probate Administration

Course Rationale:

Wills, and particularly probate administration, are areas of law practice in which an attorney may delegate a great deal of responsibility.

Learning Objectives:

Define and properly use terminology relating to wills, trusts, and probate administration; locate, describe, and analyze sources of law relating to wills, trusts, and probate administration; describe the role and ethical obligations of the paralegal in wills, trusts, and probate administration; and draft documents commonly used in wills, trusts, and probate administration.

Specific Tasks Accomplished:

Upon completion of this course, the student will be able to accomplish the following tasks:

  1. Define and properly use terminology relating to wills, trusts, and probate administration.
  2. Locate describe, and analyze sources of law relating to wills, trusts, and probate administration.
  3. Describe the role and ethical obligations of the paralegal in wills, trusts, and probate administration.
  4. Draft documents commonly used in wills, trusts, and probate administration.
  5. Write proper citations of law relating to wills, trusts and estate administration.
  6. Apply principles of the law relating to wills, trusts, and estate administration to fact situations.
  7. Describe the requisites of a valid will.
  8. Describe the process of creating and carrying out the dependent and independent administration of estates.
  9. Describe the qualifications, duties, powers, and liabilities of personal representatives.
